Don't Get Lost in the Weeds: The Latest on Marijuana and the Workplace

Presenter: Tom Bright and Tae Phillips (Ogletree Deakins)

The greater availability and proliferation of marijuana use has employers concerned. With 11 states legalizing marijuana for recreational and medical use, 21 states legalizing marijuana for medical use only, and an ever-evolving landscape of expanded recreational and medical marijuana legislation with each passing year, employers are faced with how to handle employees who show up to work impaired and employees who ask for accommodations due to medical conditions. While legal in a number of states, there is still a strong conflict with federal law. At the federal level, marijuana is regulated by the Controlled Substances Act. That law makes any use of marijuana illegal. So how does an employer reconcile state and federal law? This session exploreS the state of the law, best practices and practical advice for handling these situations, as well as a related discussion of CBD oil and the similarities/differences in handling marijuana v.
